Terms & Conditions of Hire

1. Agreement

By hiring equipment from Pinnacle Peak Hire Pty Ltd (“we”, “us”), you (“the Hirer”) agree to these Terms and Conditions.

2. Identification

The Hirer must provide valid photo identification, including a driver licence, prior to hire.

We may record these details for verification, fraud prevention, and equipment recovery purposes.

3. Hire Period

The hire period begins when the equipment leaves our premises or is delivered, and continues until it is returned and accepted by us.

Late return may incur additional charges.

4. Payment and Bond

All hire charges must be paid before collection or delivery unless otherwise agreed.

A security bond may be required and may be used to cover:

  • damage
  • cleaning
  • refuelling
  • missing parts
  • unpaid hire charges
  • recovery costs

5. Payment Authorisation

The Hirer authorises us to charge the nominated payment method for any amounts payable under these Terms, including:

  • hire fees
  • damage costs
  • cleaning and fuel charges
  • late fees
  • recovery costs

Where possible, we will notify you before processing additional charges.

6. Risk and Responsibility

Risk in the equipment transfers to the Hirer upon collection or delivery and remains until it is returned and accepted by us.

The Hirer is responsible for all loss or damage during the hire period.

7. Operator Requirements

Operators must:

  • be at least 18 years of age
  • be competent to operate the equipment
  • follow all safety and manufacturer instructions

We supply equipment only and do not provide supervision.

8. Use of Equipment

The equipment must not be used:

  • under the influence of alcohol or drugs
  • for unlawful purposes
  • beyond its rated capacity
  • to lift persons

9. Safety and Site Responsibility

The Hirer is responsible for ensuring the equipment is used safely and the site is suitable for operation.

We are not responsible for damage caused by site conditions or ground instability.

10. Underground Services

The Hirer must locate underground services before excavation, including contacting Before You Dig Australia (BYDA).

We make no warranty regarding underground infrastructure and accept no liability for damage to:

  • power cables
  • fibre or telecommunications
  • gas lines
  • water or sewer pipes
  • other underground services

11. Equipment Condition

The Hirer accepts the equipment in good working condition.

Photos and inspection records may be used as evidence of condition at the start of hire.

Any issues must be reported before use.

12. Fuel and Maintenance

The Hirer must:

  • use correct fuel
  • operate the equipment properly

The Hirer is responsible for all costs resulting from incorrect fuel or misuse.

13. Cleaning and Refuelling

Equipment must be returned:

  • clean
  • with the same fuel level

Cleaning and refuelling charges may apply.

14. Transport

The Hirer is responsible for safe transport unless delivery is arranged by us.

15. Theft and Security

The Hirer must secure the equipment and is responsible for theft, loss or vandalism.

16. GPS Tracking

Equipment may be fitted with GPS tracking.

The Hirer must not tamper with or disable tracking devices.

17. Damage and Incidents

The Hirer must notify us immediately of any:

  • damage
  • accident
  • breakdown
  • theft

18. Loss and Damage

The Hirer is responsible for all damage including:

  • rollover
  • collision
  • misuse
  • operator error
  • transport damage

19. Total Loss

If the equipment is lost or beyond repair, the Hirer must pay the replacement value.

20. Ownership

All equipment remains the property of Pinnacle Peak Hire Pty Ltd.

21. No Sub-Hire

The Hirer must not sub-hire or transfer the equipment to any other person.

22. Recovery

If equipment is not returned or this agreement is breached, we may recover the equipment and charge all associated costs.

23. Indemnity

The Hirer indemnifies us against all claims arising from:

  • use of the equipment
  • property damage
  • personal injury
  • underground infrastructure damage

24. Liability

To the extent permitted by law, we are not liable for:

  • indirect or consequential loss
  • project delays
  • loss of profit

25. Australian Consumer Law

Nothing in these Terms excludes rights under the Australian Consumer Law.

26. Governing Law

These Terms are governed by the laws of Queensland, Australia.

27. Acceptance

By proceeding with a booking or taking possession of the equipment, the Hirer confirms they have read and agree to these Terms and Conditions.
